Privacy Policy

Effective date: September 23, 2026

1. Who we are

JMC Photography, LLC ("we," "us," or "our") operates jennacollettphoto.com (the "Site"), a photography portfolio and services website based in Tennessee, United States. This Privacy Policy explains what personal information we collect, how we use and share it, and the choices and rights you have.

For purposes of the EU and UK General Data Protection Regulation (GDPR), JMC Photography, LLC is the "controller" of your personal information. You can reach us at jennacollettphoto@gmail.com or PO Box 60061, Nashville, TN 37206.

By using the Site, you acknowledge this Privacy Policy. If you do not agree with it, please do not use the Site.

2. Information we collect

Information you give us. When you use the Contact form on the Site, we collect your name, your email address, and the content of your message. Providing this information is voluntary, but we need it to respond to you.

Email updates. If you check the box to receive email updates, we add your name and email address to our mailing list and keep a record of your consent (such as the date and the form you used).

Technical information. Like most websites, our hosting provider, Squarespace, may automatically log basic technical information when you visit, such as your IP address, browser type, and the pages requested. This is used to deliver the Site and keep it secure. We do not use analytics, advertising, or tracking tools, and we do not use this information to identify you.

Sensitive information. We do not ask for sensitive personal information (such as health data or government ID numbers). Please do not include it in your message.

3. How we use your information

We use your name, email address, and message to:

  • Respond to your inquiry and communicate with you about the photography services you ask about

  • Operate and secure the Site

  • Comply with legal obligations and protect our legal rights

Email updates. If you opt in, we send occasional emails about new collections, special exhibits, and related news. We send these only to people who have agreed to receive them, and you can unsubscribe at any time by replying "unsubscribe" to any email or by contacting us. We do not track whether our emails are opened or links are clicked. Messages about services you've requested (such as replies to your inquiry or delivery of a client gallery) are not marketing emails and are not affected by unsubscribing.

Legal bases (EU/UK visitors). We process your information on these bases: legitimate interests (responding to messages you send us and keeping the Site secure); steps before a contract (when you ask about booking our services); consent (email updates, which you may withdraw at any time); and legal obligation (where the law requires us to keep or disclose information).

We do not use personal information for automated decision-making or profiling.

4. Cookies and similar technologies

The Site uses only essential cookies that our website platform needs to function, such as keeping the Site secure and loading pages correctly. We do not use analytics, advertising, or social media tracking cookies, and we do not track you across other websites.

You can block or delete cookies in your browser settings, though some parts of the Site may not work properly without them. If we add analytics or other non-essential cookies in the future, we will update this policy and, where required by law, ask for your consent first.

5. How we share information

We do not sell your personal information, and we do not share it for advertising. We share it only as follows:

  • Service providers that help us run the Site and communicate with you: Squarespace, which hosts the Site and processes Contact form submissions, and Google (Gmail), which delivers and stores our email, including email updates. They may use the information only to provide services to us.

  • Legal and safety reasons: to comply with law, subpoenas, or court orders, or to protect the rights, property, or safety of us or others

  • Business transfers: in connection with a merger, sale, or transfer of all or part of our business

  • With your consent or at your direction

6. How long we keep information

We keep Contact form messages and your name and email only as long as needed to respond to you and handle any follow-up. Inquiries that don't lead to a booking are deleted within 2 years of our last contact. If you become a client, we keep your information for as long as our business relationship lasts, plus any period required for legal, tax, or accounting purposes. If you join our mailing list, we keep your name and email until you unsubscribe; after that, we keep only your email address on a do-not-contact list so we don't email you again. You can ask us to delete your information sooner (see Section 9).

7. How we protect information

We use reasonable administrative, technical, and physical safeguards, such as encrypted (HTTPS) connections, password-protected accounts, and reputable service providers. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a data breach affects your personal information, we will notify you and regulators as required by applicable law.

8. International data transfers

We are based in the United States, and our service providers may process information in the United States and other countries. Those countries may have data protection laws different from yours. Where we transfer personal information from the EU, UK, or Switzerland, we rely on appropriate safeguards, such as the EU Standard Contractual Clauses, the UK Addendum, or a provider's certification under the EU-U.S. Data Privacy Framework and its UK and Swiss extensions. Contact us for more information.

9. Your privacy rights

Depending on where you live, you may have some or all of the following rights regarding your personal information:

  • Access / know: what personal information we hold about you and how we use and share it

  • Correction of inaccurate information

  • Deletion of your information, subject to legal exceptions

  • Non-discrimination: we will not treat you differently for exercising your rights

We will verify your identity before acting on a request, and you may use an authorized agent where the law allows. We will respond within the time required by law (generally 30–45 days). 10. Children's privacy

The Site is not directed to children under 13 (or under 16 in the EU/UK), and we do not knowingly collect personal information online from them. If you believe a child has given us personal information, contact us and we will delete it.

The Site may link to or embed third-party websites and services (such as social media, gallery platforms, or booking tools). We are not responsible for their privacy practices. Please review their privacy policies.

12. Changes to this policy

We may update this Privacy Policy from time to time, for example if we add analytics, a newsletter, or online print sales. We will post the updated version with a new effective date and, for material changes, provide additional notice where required by law, such as by email or a notice on the Site.
