1. Agreement to these Terms

These Terms of Use ("Terms") govern your use of jennacollettphoto.com (the "Site"), operated by JMC Photography, LLC ("JMC Photography," "we," "us," or "our"), a Tennessee limited liability company. By accessing or using the Site, you agree to these Terms and to our [Privacy Policy]. If you do not agree, do not use the Site.

You must be at least 18 years old, or the age of majority where you live, to agree to these Terms. If you are younger, you may use the Site only with the involvement of a parent or guardian who agrees to these Terms.

2. Ownership and copyright

All photographs, images, videos, text, graphics, logos, and other content on the Site ("Content") are owned by JMC Photography, LLC or its licensors and are protected by United States copyright and trademark laws and international treaties, including the Berne Convention. All rights are reserved.

Unless we state otherwise, every photograph on the Site is © JMC Photography, LLC. Viewing the Site does not transfer any ownership, license, or other rights in any Content to you. The absence of a watermark, copyright notice, or metadata on any image does not mean it is free to use.

"JMC Photography," our logo, and related names and marks are our trademarks. You may not use them without our prior written permission, including in any way that suggests we endorse or are affiliated with you.

3. Permitted use

We grant you a limited, personal, non-exclusive, non-transferable, revocable permission to view the Site and its Content in your web browser for your own non-commercial purposes.

Sharing. You may share a link to any page of the Site. You may not post, upload, or repost our images themselves anywhere (including social media) without our permission, except that clients may share images as allowed in their client agreement. If we give you permission to share an image, you must credit "JMC Photography" and link to jennacollettphoto.com, and you may not crop, filter, or alter the image.

4. Prohibited uses

Without our prior written permission, you may not:

  • Download, copy, screenshot, save, print, reproduce, or distribute any Content

  • Use any Content for commercial purposes, including advertising, marketing, products, or merchandise

  • Modify, crop, edit, filter, or create derivative works from any Content

  • Remove, alter, or obscure any watermark, copyright notice, signature, or embedded metadata

  • Claim any image as your own, or submit it to contests, stock agencies, or publications

  • Use any Content to train, fine-tune, test, or prompt artificial intelligence or machine learning systems, or to generate images "in the style of" our work

  • Use bots, crawlers, scrapers, or other automated tools to access or collect Content

  • Hotlink, frame, or embed Content on another website or app

  • Interfere with the Site's security or operation, or use the Site for any unlawful purpose

These restrictions apply whether or not an image displays a watermark or copyright notice. Any use not expressly permitted by these Terms is prohibited and may violate copyright and other laws.

5. Licensing and permissions

To license an image for personal, editorial, or commercial use, email jennacollettphoto@gmail.com with the image, how you plan to use it, and for how long. Permission is valid only if it is in writing from JMC Photography, LLC, and only for the use, term, and territory it describes. Fees may apply.

6. Copyright infringement

We actively protect our work. Unauthorized use of our Content may result in a demand for removal, licensing fees for past use, takedown notices to hosting providers and platforms, and legal action, including claims for damages, statutory damages, and attorney's fees where available by law. Using our Content in violation of these Terms automatically ends your permission to use the Site.

If you see our images used somewhere without credit or permission, we'd be grateful if you let us know at jennacollettphoto@gmail.com.

7. People in our photographs

Images on the Site may show our clients and other people. We publish them where permitted by law. You may not use any image of a person from the Site for any purpose, including to identify, contact, or comment on that person. If you appear in an image and want it removed, see our [Privacy Policy].

8. Client galleries

If you are a client, your rights to use photographs we create for you, including any private online gallery, are set out in your client agreement. If your client agreement conflicts with these Terms, your client agreement controls. Unless your client agreement says otherwise, JMC Photography, LLC keeps the copyright in all images, and you may not share access to a private gallery or its password with anyone not authorized in your agreement.

9. Third-party links and services

The Site may link to or embed third-party websites and services, such as social media. We do not control them and are not responsible for their content, policies, or practices. Your use of them is at your own risk and governed by their terms.

10. Disclaimer of warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. Information on the Site, including pricing or availability, may change without notice and is not a binding offer.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JMC PHOTOGRAPHY, LLC AND ITS OWNERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain warranty exclusions or liability limits, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, or any rights you have as a consumer under the mandatory laws of your country.

12. Indemnification

You agree to defend, indemnify, and hold harmless JMC Photography, LLC and its owners, members, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from your violation of these Terms, your misuse of the Site or any Content, or your violation of any law or the rights of a third party.

13. Governing law and disputes

These Terms are governed by the laws of the State of Tennessee and applicable U.S. federal law, including the U.S. Copyright Act, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Davidson County, Tennessee, and you consent to the personal jurisdiction of those courts. Before filing a claim, you agree to contact us first and try in good faith to resolve the dispute informally for at least 30 days.

Nothing in these Terms prevents us from seeking an injunction or other relief in any court with jurisdiction to protect our copyrights, trademarks, or other intellectual property.

14. International users

The Site is operated from the United States. If you access it from elsewhere, you are responsible for complying with local laws. Our copyrights are protected in most countries through international treaties, and the restrictions in these Terms apply wherever you are. If you are a consumer in the EU, UK, or another country whose laws give you the right to bring claims in your local courts, these Terms do not take away that right.

15. Changes and termination

We may update these Terms at any time by posting a new version with a new effective date. Your continued use of the Site after changes are posted means you accept them. We may suspend or end your access to the Site at any time, without notice, if we believe you have violated these Terms. Sections 2, 4, 6, and 10 through 16 survive termination.

16. General

These Terms, together with our Privacy Policy and any written license or client agreement with us, are the entire agreement between you and us about the Site. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a sale or transfer of our business.
